A federal appeals court is looking skeptically at Arizona?s attempt to ban abortions after 20 weeks, the Associated Press reports.?The ban, passed last April, is one of the most restrictive abortions laws in the country and directly contradicts Roe v. Wade.
Under Roe v. Wade,?s aren?t allowed to ban abortion outright before the point of viability, which is the point at which a fetus could survive on its own outside the womb. This is generally considered to be sometime after 23 weeks of pregnancy, making Arizona?s 20-week ban clearly unconstitutional.
The ?s attorney argued before the 9th Circuit Court of Appeals that the law was for women?s own good, because undergoing an abortion after 20 weeks was too dangerous. It?s a pretty flimsy argument, considering women have abortions at 20 weeks (5 months) all the time without complications.
According to AP, even the court?s most reliably conservative jurist, Judge Andrew Kleinfeld, was not convinced.??People decide to have dangerous, foolishly dangerous, medical procedures all the time,? said Kleinfeld. Dangerous or not, such medical decisions should be left up to patients and doctors without government intrusion.

No word on when the court will actually rule, but it could have far-reaching consequences. Though Arizona is one of 10 s that have enacted a 20-week abortion ban, it?s the first to have its ban tested in court.
